Roman Polanski’s lawyers will argue for his 1970s conviction for having sex with a 13 years old girl, to be dismissed for judicial misconduct next month at a hearing in Los Angeles, legal sources reported.
California’s 2nd District Court of Appeal will hear Polanski’s lawyers argue to turn over an inferior court ruling in May that dismissed the case. The judge said in the May ruling that Polanski “was not entitled to request any affirmative relief from this court, as he remains at large”. The judge also said that it would be in the benefit of the dismissal request if Polanski returned to Los Angeles County.
Polanski fled the States in 1978 on the eve of a sentencing hearing and he is presently being held in Switzerland following his arrest on September 26.
